This is a point at issue question, so we something about which they would disagree. To test if an answer choice is correct, you can put an initial for each speaker next to the answer choice and then ask whether the speaker would agree or disagree with the statement. We want something where one agrees and the other disagrees with the statement.
Answer choice (E) states that "Roseville would have expended $4 million to maintain a courthouse from 1982 to 1992." I might be missing something, but I'm not seeing any material that would let us know how either speaker would feel about this statement. We don't know how much Mayor Tyler thinks it'd cost to maintain a courthouse during that time period, nor do we know Councillor Simon's views on that matter either.
By contrast, answer choice (D) states that "Roseville actually needed a new courthouse between 1982 and 1992." We know that Mayor Tyler would agree with this, because that speaker indicated that overcrowding was an issue. We know that Councillor Simon would disagree because that speaker suggests it would have been "an underutilized courthouse for ten years." That confirms that this is a point at issue between them.
