If this question does not specify according to the third paragraph, would E, prosecutors are not penalized for offering incentives to cooperating witness in exchange for testimony be correct? Did I use common sense not mentioned in the passage to think about this question?

The problem with answer choice (E) is that it doesn't address the safeguards. It's a general issue with using these types of witnesses, but it's not a problem with the safeguards. The safeguards mentioned in the passage were specific to the ability to cross-examine cooperating witnesses about any potential offers.
