I was debating between D and E but I went with D because of the 4th paragraph in passage A. Can someone explain why D is wrong and E is correct

Hi JK,

The key difference between answer choices (D) and (E) is that (D) supports legalizing one kind of insider trading but not another, while (E) unreservedly supports legalizing insider trading, the only caveat being that the information on which the insider trades were based was lawfully obtained. The author of passage A doesn't draw any distinction between the types of insider trading mentioned in (D), and seems to unreservedly support legalizing insider trading, thus (E) is the correct answer.

A was confused by the question here. It states, "Which one of the following laws would conform most closely to the position articulated in passage A, but NOT THAT articulated by the author of passage B." Is this asking which one of the following laws is clearly supported by passage A, and supported by B even though it wasn't articulated?

Also, I was confused by E because it says, "as long as that info is not acquired by theft or other unlawful means." When did the author in passage A ever reference or imply that he/she cared about whether things were lawful or not.

The question stem asks you what is supported by Passage A but not supported by Passage B.

Your first goal is to find a law that Passage A would agree with, and then make sure it isn't consistent with Passage B.

Looking through the choices,

A, B, D -- contrary to Passage A
C -- this is supported by Passage B, so wrong passage

This leaves (E). It doesn't matter whether (E) contains some extraneous material, the general idea is that Passage A thought insider trading should be legal. If you want support for the "lawful means" stuff, look around line 14. The author does think it's important that the information is gained properly.
