I had trouble with question 9:

I was torn between D) and E) and eventually picked D) since the author says that those political compromises looked more to the "temper of the times than to enduring principles of law." Thus, I thought the problem doesn't lies in political compromises per se, but with that second half of the sentence (looking more to the temper of the times instead of the enduring principles of law). However, the correct answer is E). What makes D) wrong and E) right?

Thank you!

Hello,

"Temper of the times" may refer to political conditions around the time of a Court decision, not to some bad things settlers did in the past, as answer D talks about.
And actually, paragraph 3 notes that the Court has taken account of the bad actions of settlers, and in doing so has helped Native Americans.
So, answer E, about political compromises, is the best answer.
