Why is it not D)? Is it because of the word "misguided"? I actually thought the 1st paragraph demonstrated that but am i misinterpreting the author's belief?

Answer D is wrong not only, it seems, by using "misguided", but also wrong by saying "harmless". The article seems to indicate the Supreme Court has been positively helpful, not just harmless.
