I originally chose D and then upon review, switched to C. What made me uncomfortable with D is that Passage A does not actually mention criminal justice. So I was thinking they may also be talking about civil proceedings, and thus D would be wrong. So why is D right?

The last sentence of Passage A refers to "accused lawbreaker", so there is no need to assume it's talking about the criminal justice system - that phrase indicates that we are talking about potential or actual violators of criminal law.
